Terms of Service
1. Definitions
In these terms: "DenBrain", "we" and "us" mean DenBrain Ltd, a company registered in England and Wales (company number 17494466), registered office 3 Chrislea Close, Hounslow, TW5 0DL; "Customer" and "you" mean the dental practice or business that creates a DenBrain account; "Service" means the DenBrain software service, including Smile Preview; "Customer Data" means data submitted to or collected through the Service by or for the Customer, including patient data; "Subscription" means the plan you select; "Smile Preview" means the feature that creates an illustrative visualisation from a patient's photo; "DPA" means the data processing agreement at /dpa.
2. About DenBrain
The Service is provided by DenBrain Ltd. You can contact us at hello@denbrain.co.uk. The Service helps dental practices turn online patient interest into enquiries and booking requests.
3. Eligibility and authority
The Service is for business use by dental practices and related businesses, not consumers. By creating an account you confirm that you are acting for a business and have authority to bind it to these terms.
4. Accounts
You must give accurate account information and keep it up to date. You are responsible for keeping credentials confidential, for activity under your account, and for ensuring that people you give access to are authorised. Tell us promptly at hello@denbrain.co.uk if you suspect unauthorised access.
5. Subscription
Access to the Service requires a Subscription (or an active trial). Subscriptions renew automatically for the same billing period until cancelled, and are for the Customer's own business.
6. Pricing
Fees are stated in pounds sterling. The paid plans are:
- Smile Preview: £49 per month or £539 per year, 50 Smile Previews per month.
- Complete: £99 per month or £1089 per year, 100 Smile Previews per month.
- Pro: £299 per month or £3289 per year, 500 Smile Previews per month.
- Annual billing changes how often you pay; the Smile Preview allowance is always monthly and unused allowance does not carry over.
7. Billing
Fees are payable in advance for each billing period using the payment method you provide through the billing flow in your account.
Payments are currently processed through Stripe using an account registered to Dot it Media Ltd, so Stripe receipts and card statements may show that name or Stripe. The Service itself is provided by DenBrain Ltd. We expect to move billing to an account held by DenBrain Ltd and will tell you before that change takes effect.
8. VAT and taxes
Any VAT or other tax that applies to a charge will be shown on your invoice or receipt. Fees are as stated in the billing flow at the time you subscribe.
9. Promotions
Promotion codes apply as stated when issued. They may be limited to particular plans, billing periods or customers, cannot be combined unless stated, have no cash value, and may be withdrawn or expire. We may refuse or reverse a promotion applied in error or through misuse.
10. Trial
New accounts start with a 30-day free trial that includes 10 Smile Preview generations and needs no payment card. At the end of the trial you need a paid Subscription to continue using the Service.
11. Usage limits
Each plan includes the monthly Smile Preview allowance shown under Pricing. When the allowance is used up, further previews are not generated until the next monthly window or until you change plan. We may apply technical limits (for example rate limits) to protect the Service.
12. Acceptable use
You must not, and must not allow anyone else to:
- use the Service unlawfully or to infringe anyone's rights;
- upload or process photos or data you do not have the right to use, or process a person's photo without the consent the law requires;
- present Smile Preview results as a diagnosis, treatment plan or guarantee, or otherwise mislead patients;
- attempt to gain unauthorised access to, disrupt, probe or overload the Service or other customers' data;
- reverse engineer the Service or use it to build a competing product, except where the law permits;
- use automated means to generate previews other than through the Service's intended flows.
13. Customer responsibilities
You are responsible for the content you configure (such as treatments, descriptions and booking links), for the accuracy of what you tell patients, and for complying with the laws and professional rules that apply to your practice, including marketing and advertising rules. You are responsible for how you follow up enquiries and booking requests. A booking request is not a confirmed appointment until you confirm it.
14. Patient data
As between the parties, you are the controller of patient personal data processed through the Service for your practice, and DenBrain Ltd is your processor. We process that data only on your documented instructions (these terms and your use of the Service), except where the law requires otherwise. For personal data we handle for our own purposes (such as your account, billing, security and service administration) we are a separate controller, as described in our Privacy Notice.
You are responsible for having a lawful basis for the processing you instruct, for the information you give to patients, for obtaining the patient consents the Service asks for and any further consents you need, and for responding to patients' requests as controller. We will give reasonable assistance.
15. Data Processing Agreement
The DPA, published at /dpa, forms part of these terms and applies automatically to patient personal data we process for you as your processor. It sets out the details required by Article 28 of the UK GDPR, including our subprocessors (listed at /subprocessors) and the technical and organisational security measures (published at /security). If these terms and the DPA conflict on the processing of personal data, the DPA prevails.
16. Intellectual property
The Service, including its software, design and documentation, belongs to us and our licensors. You keep your rights in Customer Data. You grant us a limited licence to host and process Customer Data only to provide the Service to you.
17. DenBrain licence
While your Subscription is active we grant you a non-exclusive, non-transferable, revocable right to access and use the Service for your own business purposes, in accordance with these terms.
18. Third-party services
The Service relies on third-party providers (for example hosting, storage, image generation, email and payments). Links and integrations to third-party services are governed by those providers' terms. We are not responsible for services we do not control, but we remain responsible to you for our subprocessors' performance of our obligations as the law requires.
19. Smile Preview limitations
You choose how the simulator handles booking (an enquiry with a thank-you message or page, a connected booking system, or your own booking link) and you are responsible for responding to the enquiries it sends you, for the website pages it links to, and for the consent banner and consent signal on your own website; DenBrain does not arrange or confirm appointments. Smile Preview creates an illustrative visualisation using automated image generation. It is illustrative only. It is not a diagnosis, not a treatment plan, and not a prediction or guarantee of any clinical outcome. It may be inaccurate or unrealistic and does not replace assessment by a dental professional. Results can vary and a preview may fail to generate. You must make the illustrative nature of results clear to patients and must not promise results based on a preview.
20. Availability and changes
We aim to keep the Service available but do not promise uninterrupted or error-free operation. We may carry out maintenance and may change, improve or discontinue features, giving reasonable notice of material changes where practicable.
21. Confidentiality
Each party will keep the other's non-public business information confidential, use it only for these terms, and disclose it only to people who need it and are bound to confidentiality, or where the law requires. This does not apply to information that is public through no fault of the recipient, or independently developed or lawfully received.
22. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Except as expressly stated, and to the extent the law permits, we exclude all other warranties, conditions and terms implied by law, and the Service is provided as available. Nothing in these terms affects any right you have that cannot lawfully be limited.
23. Liability
Nothing in these terms limits or excludes either party's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
Subject to that, neither party is liable to the other, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings, arising under or in connection with these terms.
24. Suspension and termination
We may suspend access, in whole or part, for material breach, non-payment, serious misuse, or where reasonably necessary for security, legal or regulatory reasons. Where practicable we will give notice and a reasonable opportunity to remedy first, unless immediate action is reasonably necessary.
You may cancel at any time through the billing mechanism in your account. Cancellation normally takes effect at the end of the current paid billing period, and you keep access until then.
We may terminate for material breach that is not remedied within a reasonable period after notice, for non-payment, for serious misuse, or for security, legal or regulatory reasons, acting immediately where reasonably necessary.
Refunds are handled in accordance with applicable law. Nothing here removes any statutory right that cannot be excluded.
25. Data return and deletion
When your account ends, or on your written request, we will at your choice return or delete Customer Data within 30 days of the request, except where the law requires us to keep it (for example billing records). Copies in encrypted backups expire automatically within 35 days afterwards. The retention periods that apply in the meantime are in the Privacy Notice and the DPA.
26. Changes to Terms
We may update these terms, for example to reflect changes to the Service or the law, giving reasonable notice of material changes. If you do not accept a change you may cancel before it takes effect; continued use after it takes effect means you accept it.
27. Governing law
These terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the law of England and Wales.
28. Jurisdiction
The courts of England and Wales have exclusive jurisdiction over any such dispute or claim. Last updated: 28 October 2026.
